Terms and Conditions for ScriptIrc / scriptirc.io

Please read these Terms and Conditions (“Terms”) carefully before using the scriptirc.io website, applications, APIs, plugins, or other services (collectively, the “Service”) provided by ScriptIrc (“we”, “us”, “our”, “ScriptIrc”). These Terms govern your access to and use of the Service. By accessing or using the Service you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

1. Acceptance of Terms
By using the Service, you confirm you are at least 13 years old (or older if required by local law) and you accept and agree to be bound by these Terms, our Privacy Policy, and any documents incorporated herein by reference. If you are under 18, you must have the consent of a parent or legal guardian. We may refuse service, terminate accounts, or deny access in our discretion.

2. Definitions
– “Service” means scriptirc.io and all features, content, tools, software, APIs, and other functionality provided by ScriptIrc.
– “User” or “you” means any person or entity using the Service.
– “User Content” means any content that a User submits to the Service (including text, code, prompts, plugins, images, profiles).
– “Generated Content” means content produced by the Service or its AI on behalf of a User.
– “Credits” means any virtual currency, tokens, or balances used within the Service to access premium features.

3. Changes to Terms
We may modify these Terms at any time. Material changes will be posted with a new “Last Updated” date and, where appropriate, we will notify users by email or site notice prior to the change taking effect. Continued use after changes constitutes acceptance of the updated Terms.

4. Privacy and Data Storage
– Our Privacy Policy, available on the website, describes how we collect, use, store, and share personal data. You agree to that policy as part of these Terms.
– ScriptIrc is built on WordPress and stores user data (including but not limited to chat logs, User Content, account data, API keys, and configuration settings) on our servers and in our managed databases; chat history is not stored solely in your browser.
– We use commercially reasonable technical and organizational measures to protect data. However, no system is completely secure; you accept the residual risk.
– You are responsible for maintaining the security of credentials associated with your account.

5. Accounts, Registration, and Authentication
– You may be required to register and create an account to use certain features. You must provide accurate, current, and complete information.
– You are responsible for safeguarding passwords and any authentication methods and for any activity that occurs under your account.
– You must notify us immediately of any unauthorized use or suspected compromise of your account.

6. Free Usage, Authorization, and Access
– We may provide free features or trial usage. Free features and promotional access are provided at our discretion and may be modified, limited, or discontinued at any time.
– Authorization methods (login or API keys) are required for access management. We do not require third-party logins (e.g., Google, GitHub) and do not impose daily message limits unless explicitly communicated in product materials.

7. User Conduct and Acceptable Use
You agree not to:
– Use the Service for unlawful activities or to transmit illegal content.
– Interfere with or disrupt the Service or servers or networks connected to the Service.
– Attempt to probe, scan, or test the vulnerability of any system or network or breach security or authentication measures.
– Transmit viruses, malware, or other harmful code.
– Collect or harvest personal data of other users without consent.
– Use the Service to generate, publish, or distribute content that is defamatory, obscene, pornographic, abusive, harassing, hateful, violent, or otherwise objectionable.
– Use the Service to infringe any third party’s intellectual property rights or privacy rights.
– Use the Service to conduct high-risk activities where inaccuracies or failures could lead to death, personal injury, or environmental or physical damage (e.g., life-critical systems) without independent verification and acceptance of risk.

8. User Content
– You retain ownership of User Content you submit, but by submitting User Content you grant ScriptIrc a non-exclusive, worldwide, transferable, sublicensable, royalty-free license to host, use, store, copy, modify, display, distribute, and otherwise process such content for the purpose of providing, operating, improving and developing the Service, including for security, analytics and training improvements in anonymized or aggregated form, unless restricted by applicable law or separate agreement.
– You represent and warrant that you own or have all necessary rights to submit User Content and that use of such content by ScriptIrc will not violate any rights of third parties.

9. Generated Content and License to Users
– Generated Content (including code, scripts, plugins, text, and other artifacts produced by our AI) is provided to you under a non-exclusive, worldwide, perpetual (unless otherwise stated), royalty-free license to use, reproduce, modify, publish, and distribute for personal or commercial purposes, subject to these Terms and any laws or third-party rights.
– You are responsible for verifying and testing Generated Content prior to deployment. You assume all risks associated with your use of Generated Content (including Minecraft plugins and other code).

10. Minecraft Plugin and Code Generation Disclaimer
– Any plugins, mods, or code generated by the Service are provided “as is” without warranties regarding fitness for purpose, compatibility, security, or non-interference with other systems.
– Generated code may contain bugs or vulnerabilities. You must test thoroughly in a safe environment before using in production.
– We are not responsible for data loss, server damage, downtime, or other issues arising from use of generated code.

11. Intellectual Property
– ScriptIrc and its licensors retain all rights not expressly granted to you. Trademarks, logos, and trade dress are our property.
– If you believe any content on the Service infringes your copyright, follow our DMCA policy (section 24) to request removal.

12. Payments, Fees, and Credits
– Certain features are paid. Prices, billing cycles, and subscription details are described on the site and are subject to change.
– Purchases of Credits are final and non-refundable except as required by law or as explicitly determined by us.
– Credits have no monetary value outside the Service; they are non-transferable (unless explicitly allowed) and non-exchangeable for cash.
– We reserve the right to set, change, or discontinue prices, fees, and Credits in our discretion.
– Credits usage: Credits are deducted upon feature usage. We may adjust costs; changes may apply to future usage.
– Inactivity and expiration: Credits do not expire while your account is active. We may expire credits if an account is inactive for more than 12 consecutive months. On termination of your account any remaining credits are forfeited unless otherwise required by applicable law.

13. Billing Disputes; Chargebacks
– If you dispute a charge you must first contact us at contact@scriptirc.io to attempt resolution. Unauthorized chargebacks may result in suspension or termination of service.

14. Taxes
– You are responsible for any taxes associated with payments for the Service as required by applicable law.

15. Subscriptions and Renewals
– Subscription services auto-renew unless canceled prior to renewal date. You may cancel in account settings or by contacting support. Cancellations do not obligate us to provide refunds unless specified.

16. Security; Data Breach
– We use reasonable administrative, physical and technical safeguards to protect user data.
– In the event of a data breach affecting personal data, we will investigate, mitigate, and notify affected users and regulators as required by applicable law.

17. Backup, Data Retention, and Deletion
– We maintain backups which may contain copies of user data for a period consistent with our backup and retention policies. Deleted accounts or content may persist in backups until those backups are rotated.
– You may request account deletion by contacting support@scriptirc.io. We will process deletion requests in accordance with our Privacy Policy. Certain data may be retained to comply with legal obligations, resolve disputes, or enforce our agreements.

18. Third-Party Services, Plugins, and Integrations
– The Service may integrate with or utilize third-party services, plugins, payment processors, analytics, or hosting providers. Those third parties have separate terms and privacy practices. We are not responsible for their actions or omissions.
– Using certain features may require acceptance of additional third-party terms.

19. Warranties and Disclaimers
– THE SERVICE, INCLUDING ALL USER CONTENT AND GENERATED CONTENT, IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
– WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
– WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE AI OUTPUTS OR GENERATED CONTENT.
– YOU ACCEPT THAT AI-DRIVEN CONTENT MAY BE INACCURATE OR INAPPLICABLE; USERS MUST INDEPENDENTLY VERIFY OUTPUTS.

20. Limitation of Liability
– TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SCRIPTIRC.IO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, OR DATA, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
– OUR AGGREGATE LIABILITY FOR DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100) OR THE AMOUNT YOU HAVE PAID TO SCRIPTIRC.IO IN THE SIX (6) MONTHS PRIOR TO THE CLAIM, WHICHEVER IS GREATER.

21. Indemnification
– You agree to indemnify, defend, and hold harmless ScriptIrc and its affiliates, officers, directors, employees, agents, and licensors from and against all claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another.

22. Termination and Suspension
– We may suspend, restrict, or terminate your access at any time, without notice, for conduct we believe violates these Terms or is harmful to other users or the Service.
– Upon termination, rights and licenses granted to you will cease. Certain provisions (e.g., sections on payments, intellectual property, disclaimers, indemnity, limitation of liability, and governing law) shall survive termination.

23. Governing Law and Venue
– These Terms and any disputes arising hereunder are governed by the laws of Canada. Any dispute, claim or controversy arising under or relating to these Terms or the Service shall be resolved exclusively in the courts located in Quebec, Canada, and you and ScriptIrc each submit to the personal and exclusive jurisdiction of those courts.

24. DMCA / Copyright Policy (for Users in Jurisdictions with DMCA)
– If you believe User Content on the Service infringes your copyright, provide a written notice containing: (a) identification of the copyrighted work; (b) identification of the infringing material and its location; (c) your contact information; (d) a statement under penalty of perjury that you are the copyright owner or authorized to act; and (e) your signature (physical or electronic). Send notices to contact@scriptirc.io.
– We will respond to valid notices and may remove or disable access to infringing content. If content is removed, the alleged infringer may provide a counter-notice pursuant to applicable law.

25. Export Controls
– You agree not to use the Service in violation of export control laws and regulations of Canada or other applicable jurisdictions. You will not access or use the Service if you are located in, under the control of, or a national or resident of any country subject to Canadian export restrictions or trade sanctions.

26. Feedback
– If you provide feedback, suggestions, or ideas regarding the Service, you grant ScriptIrc a perpetual, irrevocable, transferable, sublicensable, royalty-free license to use and exploit such feedback without obligation to you.

27. Notices
– We may provide notices by email, posting on the Service, or other reasonable means. You may provide notices to us at contact@scriptirc.io. Notices become effective upon receipt.

28. Severability
– If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

29. No Waiver
– Our failure to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision.

30. Entire Agreement; Assignment
– These Terms, together with the Privacy Policy and any additional, product-specific terms posted on the site, constitute the entire agreement between you and ScriptIrc regarding the Service.
– You may not assign these Terms without our prior written consent. We may assign or transfer our rights and obligations at any time.

31. Severely Restricted & High-Risk Use
– The Service is not designed for use in high-risk environments where failure or inaccuracies could cause death, personal injury, or environmental damage. You agree not to use the Service for such purposes and to independently validate any results.

33. Acknowledgment
